Three men were being held Friday at the La Plata County Jail on suspicion of threatening a woman with a gun and then making her perform sexual acts.
Devin “Ducky” Richard Bond, 21, Anthony “Izzy” Israel Fitts, 18, and James T. Zink, 18, all of La Plata County, were being held on suspicion of felony sexual assault. Bail was set at $150,000 in all three cases.
According to arrest affidavits, the three men met a woman at a party late Oct. 13 or early Oct. 14 on Richard Drive in northeast Durango. The woman told police she was a “little tipsy,” and she accepted a ride with the three men, expecting to go to Fort Lewis College.
Zink, the driver, dropped off a fourth man on Glenisle Avenue, and while parked outside his house or nearby, Zink picked up a shotgun and racked it. He told the woman that if she didn’t make the two other men inside the vehicle reach sexual climax, she would hear the gun fire.
Bond, who was in the backseat with the woman, began kissing the woman and touching her, according to the affidavit. He told her to take off her underwear and had sexual intercourse with her, she told police.
Zink then drove to Mustang Conoco at 901 Camino del Rio, according to arrest affidavits. Zink moved to the rear door of the vehicle and told the woman to perform oral sex on him. The woman then vomited, and the men forced her to clean it up.
While Bond was sexually assaulting the woman, Fitts climbed into the backseat and made her perform oral sex on him, she told police. They told her she was going to get “gang banged.”
Police learned of the reported sexual assaults in a round-about way.
The man who had been dropped off earlier in the evening called police early Saturday to report Zink had stolen his rent money. The man, identified as Joe “Silas” O’Connor Zubiate, 20, provided police with a description of the occupants and the vehicle they were driving.
While searching for the vehicle, officers stopped at the Durango Skate Park near the 1300 block of Roosa Avenue to question the occupants of a Toyota Sequoia. An officer observed the butt of a shotgun with a pistol grip between Zink’s right leg and center console. The officer detained the driver and noticed the woman had a look of “pure terror” on her face, according to the arrest affidavit.
Her eyes were wide and it appeared she had been sobbing heavily, the affidavit says. Police separated the woman from the men to hear her story. The woman said she didn’t know the men and had just met them that evening.
She was taken to Mercy Regional Medical Center for a sexual assault exam.
During their investigation, police found what appeared to be a small pile of vomit below the rear passenger door of the vehicle. Police also found smear marks, suggesting someone had attempted to clean the vomit, according to the affidavit.
In an interview with police, Fitts said the woman was looking for sex, and he thought it was consensual. Fitts told police Zink ordered the woman to give Fitts and Bond oral sex, which she did.
Fitts had a small scratch under his left eye that appeared to be fresh.
Formal charges are expected to be filed Oct. 27.
