Mancos man faces fourth DUI after truck bumps police car

A Mancos man with three DUI convictions faces a felony charge in Montezuma County Court for his fourth DUI.

Jason D. Gapp, 36, was pulled over at 1:30 a.m. on Feb. 2 for driving on North Broadway with his headlights turned off. According to the Cortez Police Department incident report, Gapp immediately exited the vehicle and sat on the curb. His 1999 Ford F-150 then rolled back and collided with the front of a patrol vehicle.

The report states no damage was visible on either vehicle.

Gapp faces charges of driving under the influence with three or more priors, a Class 4 felony, as well as three traffic infractions for evading a driver’s interlock device, open container and failure to display headlights.

Bond was set at $3,000 cash or surety, which Gapp posted on the day of his arrest, according to court documents.

In court Wednesday for a disposition hearing, Gapp’s private attorney, Marshall Sumrall, requested a continuance, which Montezuma County Judge JenniLynn Lawrence granted.

Sumrall also requested a bond modification to remove Gapp’s SCRAM continuous alcohol monitoring device.

Deputy District Attorney Sheena Goldsborough objected to that request, citing Gapp’s multiple DUI convictions, his blood alcohol content of 0.176 at the time of his arrest, his quick exit from the vehicle and the collision with the patrol car.

Lawrence, however, granted the request to remove the SCRAM device, stating that he will still be required to perform other sobriety tests.
