Man suspected of obstructing officer, trying to elude Cortez police

A man was arrested early June 24 on suspicion of DUI, attempting to elude police and obstructing an officer, according to the Cortez Police Department.

About 2:30 a.m., officer Kadan Sharp responded to assist officer Vance Carver, who had pulled over Brittany Killsinsight near Handy Mart, 806 S. Broadway, on suspicion of reckless driving. A male passenger left the scene on foot.

While Carver took Brittany Killsinsight to the Montezuma County Detention Center on suspicion of DUI, Sharp and Sgt. Kurtiss Baumgartner waited with her other passenger, Andrea Killsinsight.

Then the man who had left the scene pulled up in a white Chevy Silverado. Andrea Killsinsight told police his name was Shaguille Harvey.

Sharp attempted to talk with Harvey about why he left the scene, but as he approached him in the Silverado, he detected an “overwhelming odor” of an alcoholic beverage.

When Sharp asked Harvey to exit the vehicle, he allegedly refused, started his truck’s engine and “took off at a high rate of speed,” nearly running over Sharp’s feet.

As Harvey passed the officers toward South Broadway, Baumgartner threw his spike strips, causing damage to a back tire.

Harvey kept driving, nearly hitting another vehicle as he turned onto South Broadway and headed north, police said.

With Sharp in pursuit, Harvey turned into the Tomahawk Motel, 728 South Broadway, hitting the steel fence and the motel sign. He then crashed into a concrete wall barrier near the motel swimming pool.

Sharp asked Harvey to get out of the vehicle, which had a damaged door, and he knelt on his knees but refused to lie on his stomach.

Sharp placed his hand on Harvey and again asked him to lie on the ground. When Harvey allegedly pushed against Sharp, the officer used his Taser to subdue him.

Baumgarten arrived and helped force Harvey into his patrol car.

Harvey refused to perform voluntary roadside maneuvers, and at the jail, refused to take a breath test. He was then checked at Southwest Memorial Hospital and cleared for jail.

He was jailed on suspicion of charges including vehicular eluding, driving while license under restraint, reckless driving, resisting arrest and obstructing a peace officer.

He has been scheduled for a pretrial hearing in 22nd Judicial District Court on July 16 at 3 p.m.
