A preliminary hearing Thursday for Michelle Harvey of Farmington, who is accused of causing a crash that killed 11-year-old Kyrie McKensley of Towaoc, was rescheduled after her attorney failed to appear in court in Dove Creek.
Harvey was pulled over on U.S. Highway 491 south of Dove Creek for a DUI investigation on May 8. She allegedly attempted to flee the scene and nearly hit a law enforcement officer. She then hit the vehicle containing McKensley and her aunt, Amie Hammond, pushing their vehicle into oncoming traffic, causing a collision with a third vehicle, according to her charges.
Harvey has a history of DUI investigations and has been arrested on multiple other offenses in the past, all of which were dismissed.
Harvey’s 12 charges include two counts each of vehicular homicide, vehicular eluding, vehicular assault and reckless endangerment, as well as driving under the influence, obstructing a peace officer, reckless driving and illegal possession or consumption of alcohol in a vehicle.
A representative of Harvey’s legal counsel’s office appeared in court virtually to explain her attorney’s absence Thursday. The representative stated that her attorney, Justin Bogan, was in court in La Plata County at that time, and believed Harvey’s hearing was July 27.
Harvey’s new preliminary hearing is set for Aug. 15 at 1:30 p.m. in Dolores Combined Court in Dove Creek, as set by Judge William Young Furse of the 22nd Judicial District.
