Walker’s ruling in baby’s death drew criticism across the nation

Fliers depicting blood dripping over District Court Judge Doug Walker’s photo have surfaced this week in Cortez Journal news racks.

The fliers say that Walker is the “worst of the worst,” and accuse the judge that the death of a baby is on his hands.

District Attorney Will Furse said he believes that the fliers reference a decision handed down by a Judge Walker to sentence a “baby killer” to just 90 days in jail.

Furse said he notified Walker of the fliers on Wednesday.

Media outlets and blogs from around the nation criticized Walker after he ruled on Sept. 25, 2012, to sentence then-19-year-old Dylan Kuhn of Dolores to 90 days in jail for killing his infant daughter under a plea bargain. Furse said the plea deal was reached before him being elected to serve as district attorney.

An earlier story published by Journal reported that the judge cited Kuhn’s lack of a criminal history, his age and the likelihood that he would not be a repeat offender as some of the reasons for not sending him to prison.

Kuhn, who was arrested in November 2011 after his daughter died, was originally charged with manslaughter and child abuse.

Besides the 90 days in jail, Kuhn was sentenced to four years probation, mental health and substance evaluation, a parenting class and treatment, and ordered not to be allowed to be alone with children under the age of 10, court costs and possible restitution.

Under the plea agreement approved by former District Attorney Russell Wasley the child abuse and DUI cases were dismissed.

Attempts to reach Walker for comment about the flier were unsuccessful.
