Five days after being granted a $500 bond in the 22nd Judicial District, Duece Martinez, 18, was arrested on a warrant from Archuleta County for failing to appear in court and allegedly for violating a court-ordered protection order.
Martinez was arrested July 7 after Montezuma County Sheriff Deputy Peter Schmalz found him in a 2006 Dodge Charger at Hawkins Preserve, near 1515 S. Oak St.
Schmalz said that as he drove up, he saw a woman hiding in the back seat.
Martinez refused to open the car door, saying he worried that Schmalz would “rip him out” of the vehicle.
After Martinez repeatedly refused to leave the car, Schmalz pulled out a baton and Deputy Daylan Guttridge got his window breaker and Schmalz threatened to break the window and pull him out.
Martinez then exited the vehicle. He identified the woman in the car as Lillian Uptain, 19. A June court order restrains him from being near her.
While Schmalz took Martinez to the Montezuma County Detention Center, Guttridge discovered what appeared to be a bullet hole in the bumper above the tailpipe, and the Sheriff’s Office seized the car.
Because Martinez was with Uptain, he was found to be in violation of an order July 2 from 22nd Judicial District Judge Douglas Walker that allowed him out of jail on the condition that he stay away from Uptain.
The July 2 court appearance followed Martinez’s arrest for DUI on June 16, three days after he was arrested in a domestic violence case involving Uptain. During the July hearing, Martinez’s attorney, Annalise Hodges, said Martinez understood the consequences of violating the protection order.
Martinez’s next hearing is Thursday, July 18 at 11 a.m.
