Man accused of driving into brick wall at Shiloh’s Steakhouse receives ‘short setover’ for plea

A man suspected of driving into the brick wall at Shiloh’s Steakhouse, 5 S. Veach St., damaging the wall and nearly hitting bystanders, was given a “short setover” in Montezuma County Court on Tuesday.

Cody Mallett was set to have a plea hearing in front of county Judge Ian MacLaren, but the plea was moved to Tuesday, Feb. 18 at 1:30 p.m.

Mallett’s attorney explained that he wanted to meet with Mallett to go over paperwork before they moved forward with the plea, noting the pending DUI in the case.

The crash at Shiloh’s occurred on May 9. According to police reports, Mallett, who is from Arizona, was driving west in the 2000 block of East Main Street when he crashed into the driver’s side of a Chevy Silverado. Upon hitting the Chevy, Mallett lost control of the vehicle and went “airborne” through the LivWell Marijuana Dispensary parking lot, jumped the dispensary’s driveway and continued driving through the Shiloh’s parking lot.

As he entered the parking lot, he hit the Shiloh’s access ramp and went airborne again, barely missing bystanders. He crashed into three vehicles in the parking lot before hitting the brick retaining wall on the west side of Shiloh’s.

Mallett told police that he had passed out while driving and that he didn’t wake up until he had “collided with the wall.”

After the crash, open marijuana and open alcohol containers were found in the vehicle. He was cited with driving under the influence of drugs, reckless driving, open alcohol containers and open marijuana container inside a motor vehicle.

Construction to repair the wall started on Oct. 21, about five months after the crash. The sidewalk and turn lane on northbound Sligo Street were closed during construction.

The wall’s construction was completed last year.
