On Monday, the Cortez Police Department arrested Deseray Harnish for a protection order violation/possession of drug paraphernalia and Charles Alberts on a warrant, among other charges.

The pair were arrested on South Beach Street around 11:25 p.m. Officer Jacob Bourdon was informed by Sgt. Vance Carver that a GMC Sierra truck registered to Brian Gallegos had left a “well-known” drug house owned by Alberts at 616 S. Beech St., according to Bourdon’s police report.

Bourdon said Alberts was known to have two active felony warrants for his arrest.

The vehicle was located driving westbound on West Fourth Street. It stopped on the side of the road on the 300 block of West Fourth Street.

As he drove up, Bourdon said he recognized Harnish from previous contacts with her. Harnish had two separate protection orders that stated she must have no contact and must stay 100 yards away, without exception, from Gallegos.

As Bourdon approached the vehicle in his patrol car, Gallegos got out of the truck and walked toward the car while another man, who identified himself as Daniel Johnson, walked east on West Fourth Street.

Alberts was arrested on two warrants.

Officer Kadan Sharp found a piece of tin foil wrapped around a blue pill thought to be fentanyl. A straw was found on Alberts.

Once Bourdon returned to the vehicle, Harnish was no longer inside.

A hypodermic needle was on the center console, and a purse in the front seat contained several hypodermic needles, pieces of tinfoil and several drug tooter straws.

Gallegos told police the purse belonged to Harnish.

Meanwhile, another officer located Harnish near West Third Street and South Pine Street. She was arrested by officer Koltan Guttridge and taken to the Montezuma County Detention Center.

On the way to the jail, Harnish reportedly told Guttridge that she had a pipe and metal tooter straw in her bra. They were confiscated at the jail, and she was charged with violation of a protection order and possession of drug paraphernalia.

Alberts was charged with possession of drug paraphernalia, possession of controlled substances and false reporting of identifying information to law enforcement.

Harnish is set to appear in the Montezuma County Combined Courts on Jan. 1 at 10 a.m. for appearance on bond and pretrial conference. She also is set to appear Feb. 10 at 3 p.m. a probation heating for two cases, a sentencing hearing on two cases and a plea hearing for five cases.
